Scope & Content |
Letter dated February 22, 1842 and addressed to James Blaisdell from Alexander McIntire of York. In the letter Alexander is discussing Sally Shaw's (James Blaisdell's sister) visit to his side of York River to consult lawyers on the validity of James's father's deed to James and his brother Ebenezer Blaisdell. Alexander states that Sally was determined to contest it in law, on the ground of incompetency in their father to convey property when the deed was made, saying he was insane for ten or twelve years prior to the time the deed was made and up to the time of making the deed and from that time until his death. Saying he was never capable of transacting business of any kind. Alexander says he told her not to enter into a lawsuit, but to compromise the matter peacefully between themselves. If a lawsuit begins, there will be less chance for a settlement, as the lawyers on both sides will want to make the most of it, and will prevent a settlement until they have fleeced both parties. Alexander's advice to James and his brother is the same -- settle with Sally Shaw and his other sisters without going to court -- and when he settles with them, take a quitclaim deed from each of them, signed also by their husbands. Alexander states that if James goes to Sally calmly, and keeps his temper down, he may settle with her without much difficulty, but as she is "high grit", it will answer no good purpose for James to get angry. If James and his brother will see her and talk the matter over calmly, James may save themselves and her, much trouble and expense. Alexander signs off but states he hopes James will do this, and he believes James will settle the affair without entering into an expensive lawsuit. Signed, "I am respectfully sir, your friend and humble servant, Alex. McIntire" |
