Possibly divorce settlement or record between Susanna Preble and Benjamin Smith dated July 12, 1816. The legal document is 6 pages and is handwritten in black ink. At the end the document is signed by Benjamin Smith, Samuel Preble Jr., Susanna (Preble) Smith, and witnessed by John L. Johnson, David Cummings, Alexander McIntire, and Sophia Lunt. The letter begins as, "This indenture made and concluded this twelfth day of July in the / year of our lord one thousands eight hundred and sixteen, between Benjamin / Smith of Salem in the county of Essex, merchant and Susanna his wife / of the one part and Samuel Preble Junior of York in the County of York / gentleman of the other part. witnesseth, whereas [illegible] unhappy differences have / for the space of some time past arisen between the said Benjamin and / the said Susanna in so much that the said Susanna hath lived sole and / separate from the said Benjamin and at her own expense without charging / her said husband with any debt or debts whatsoever for her maintanence. / And whereas the said Benjamin is content and willing that the / said Susanna shall ever have after live separate and apart from him / and shall not only keep and enjoy all the estate, goods, chattles, / and credits with whatsoever which now hath or any other person / has in trust for her' but also all other estate, goods, chattles, or credits / whatsoever which the said Susanna by her own industry shall obtain / or acquire or which by any gift, or devise she the said Susanna / may attain or acquire to the only sole and separate use of the / said Susanna and her asigns. Now this indenture witnesseth / that as well for the consideration aforesaid as for and in consisid / eration of the sum of one dollar to the said Benjamin by the said / Samuel Preble Junior paid, the receipt whereof the said / Banjamin doth hereby acknoweldge he the said Benjamin doth / herely grant, bargain, sell, asign, and set over to the said Samuel, / all the real estate of which he is not....." |
